The case concerned a child born in Portugal in 2006 to Portuguese married parents. In May 2010, a Portuguese court decreed the parents’ divorce and approved their agreement for the settlement of parental responsibilities, whereby the child was entrusted to the care and custody of the mother, with parental responsibility being exercised jointly.
On 26 November 2012, the mother moved to France with the child without the father’s consent. On 25 April 2013, the competent judge at first instance (family judge at the Regional Court (Tribunal de Grande Instance) of Paris) found the removal to be wrongful and ordered the child’s immediate return to Portugal. The mother appealed against that decision.
