“共同親権の制度 導入すべき” 自民の作業チームが法相に提言
離婚後の子どもの養育の在り方などをめぐり、自民党の作業チームは、原則として、父親と母親が引き続き責務を果たすため、双方が親権を持つ「共同親権」の制度を導入すべきだなどとした提言をまとめ、古川法務大臣に提出しました。 親が離婚したあとの養育費の不払いや親権の在り方など、子どもの養育をめぐる課題の解消に向けて、法務大臣の諮問機関である法制審議会の部会は制度の見直しに向けた議論を行っています。 こうした中、自民党の法務部会の作業チームは子どもの養育の在り方などをめぐって提言をまとめ、21日、古川法務大臣に提出しました。 この中では、離婚した場合、原則として父親と母親が引き続き子どもに対し責務を果たすため、双方が親権を持つ「共同親権」の制度を導入すべきだとしています。 また、離婚する場合、父親と母親が子どもの養育を適切に行うため「監護割合」や養育費などについて定める「共同養育計画」の作成など、必要な事項について一定の責務を課すべきだとしています。 さらに「共同親権」の制度の導入に伴い、父親と母親の一方がDV＝ドメスティック・バイオレンスや児童虐待を働いているなど、原則どおりに適用すると不都合が生じ得るケースについて、安心・安全の観点から丁寧に対応する規律を設けるべきだなどとしています。
