Mark represents clients in complex, high-value family matters, and has particular expertise in matters involving international elements. He has acted in many of the leading cases on the treatment of trusts on divorce, often where there has been linked trust litigation offshore, including acting for John Charman in a landmark Court of Appeal decision, and for Stuart Crossley in a pioneering a new procedure on divorce where there is a pre-nuptial agreement, in leading Court of Appeal case. Mark also acts in international children’s cases. His Court of Appeal case of K v K helped to shape the law on relocation. In S v S, Mark achieved relocation but also change of primary carer for the children. Mark is noted for his ‘very comprehensive knowledge of the law, especially international law’ and ‘great expertise when trusts come into play.’ He is the co-author of three leading textbooks on family law: International Trust and Divorce Litigation (Third Edition), which was praised by Sir James Munby, President of the Family Division, as a ‘book which needs to be in the bookcase and in the briefcase of everyone involved on a divorce case with a trust element’; Same Sex Marriage and Civil Partnership – The New Law; and Model Letters for Family Lawyers.
