The child, a girl, was nearly 10 years old at the date of the alleged wrongful removal. She had lived in Italy all of her life. Her parents were separated the mother had primary care, the father frequent access. On 27 September 2000 the mother took the child to Chicago, USA.
She left the father a note explaining that this trip was due to a family emergency in Chicago. On 2 October the mother sought a protection order against the father in an Illinois court. On 6 October she initiated divorce proceedings there. The father subsequently petitioned for the child’s return.
