The child, a girl, was 13 1/2 at the date of the alleged wrongful removal. She had lived in Ireland all of her life. The parents were separated. The father lived in Scotland and the mother, with whom the girl resided, in Ireland.
On 28 April 1995 the girl went to Scotland with the help of her aunt.
On 17 August 1995 the Outer House of the Court of Session ordered the return of the girl.
