The child, a girl, was almost 1 at the date of the alleged wrongful removal. The parents were married. On 17 June 1992 the mother took the child to Scotland, her State of origin.
In November 1992 the Sheriff Court awarded the mother custody of the child. The father sought return of the child.
On 23 July 1993 the Outer House of the Court of Session ordered the return of the child.
The mother appealed.
