The child, a girl, was 8 at the date of the alleged wrongful removal. She had lived in Portugal and England. The parents were separated and the mother had physical custody of the child in England. The father lived in Portugal.
On 21 February 1992 the mother took the child to Australia for a six-week holiday. They did not return. On 11 August 1992 the father applied to the English Central Authority for the enforcement of his custody rights and for the return of the child.
On 6 October 1992 the Central Authority for South Australia filed an application for the return of the child.
On 8 April 1993 the Family Court (Adelaide) ordered the return of the child on the condition that the father undertake, inter alia, to pay periodic maintenance to the mother.
On 6 May 1993 the Central Authority for South Australia appealed the imposition undertakings.
