A Swedish husband and an Estonian wife lived together in Sweden. On 22 December 2011 the wife, then pregnant, went to Estonia and on 26 December 2011 (i.e. four days later) gave birth to the couple’s son. The mother never returned to Sweden with the baby.
The father visited his wife twice in Estonia to persuade her to go back to Sweden and take the son with her. She refused. The father filed for the return of the child to Sweden. The county court decided not to return the child, the father appealed.
