Information:

The children were aged 6, 5, and 3 at the date of the application for access. On 26 April 1991 the mother unilaterally took the children to England in breach of the father’s rights of custody.
On 8 November 1991, upon undertakings being volunteered, the High Court granted a return order
In March 1992, at a contested inter partes hearing, the Superior Court of California gave the mother leave to relocate to England with the children. Subsequently the father initiated proceedings under the Convention to enforce his rights of access.
