Information:

The application related to two children, born in April 1997 and April 1999 respectively. They had lived in Sweden with their parents until early 2004 when they relocated to Australia with their father. Prior to the move a district court in Sweden made an order with regard to access arrangements. This order was subsequently upheld on appeal.
Contact initially took place, but ended in July 2005. In May 2006 the mother sought the enforcement of her access rights pursuant to the 1980 Hague Convention and in June 2007 she travelled to Australia. In August 2007 the State Central Authority filed proceedings in the Family Court of Australia. Prior to the trial an independent children’s lawyer was appointed.
