Information:

The child, a boy born 14 January 1981, was 11 years old at the time he was wrongfully retained by his maternal grandparents in Ontario. The child’s mother was deceased and the father had de jure and de facto custody of the child in the United Kingdom.
A return application was commenced by the father on 19 December 1991 after the grandparents failed to return the child after a vacation visit. The grandparents conceded that the child was being retained in breach of the father’s custody rights but argued that the child did not wish to return to his father’s care in the United Kingdom.
